REGISTRATION: This is an online-only auction. You must register online to bid and agree to all terms. By registering, all bidders acknowledge having read and agreed to be bound by these Auction Terms and Conditions. A bidder registering confirms full understanding of these terms and unconditionally agrees to be bound by them, along with any additions, deletions, or revisions published by Higher Calling Auctions before the auction begins. If you have not reviewed the real estate sale terms, do not bid. Bidders are encouraged to inspect all properties.

SPECIAL NOTES: All property sells AS IS, WHERE IS with no warranty written or implied by Higher Calling Auctions or the sellers. Items remaining on or in the property at closing convey with the property. A successful bidder who fails to return the signed contract and earnest money by end of business on auction day is in default. Higher Calling Auctions reserves the right to charge a $1,000 penalty to the bidder’s registered credit card. Further default remedies are reserved for Higher Calling Auctions and the seller. Property may be offered to the second-highest bidder if the winning bidder fails to comply.

AUCTION END TIMES: Higher Calling Auctions online auctions are timed events with a set closing time. Auto-extend applies. If a bid is placed in the last 5 minutes, the countdown resets to 5 minutes. If bidding extends beyond 15 minutes, the reset time changes to 3 minutes. The auction continues extending until no bids are received during the final period.

ACCEPTANCE OF FINAL BID: Seller reserves the right to accept the final bid.

BUYER’S FEE: A buyer’s fee of three percent (3%) will be added to the high bid and included in the total purchase price. Example: if the high bid is $100,000, the contract will be written for $103,000.

DOWN PAYMENT: The winning bidder must submit a $10,000 non-refundable earnest money deposit by end of day following the auction close. Accepted forms include personal or business check, certified check, or wire transfer. Buyer pays any wire fees. Balance is due within 30 days or at closing.

FINANCING: Financing is not a contingency of sale. Bidders should confirm financing availability in advance. This is a cash transaction.

AUCTION CONTRACT: Winning bidder must execute the contract and deliver the earnest money deposit by the deadline stated in Section 6.

CLOSING & COSTS: Buyer closes within 30 days of auction. Buyer pays purchaser’s side closing costs. Seller pays seller’s side closing costs, including title insurance.

POSSESSION: Buyer receives possession at closing. All remaining items at closing convey with the property.

EVIDENCE OF TITLE: Seller provides an Owner’s Policy of Title Insurance for the purchase price and conveys title via warranty or Trustee’s deed. Easements and legal documents are available for review at www.bidwithhca.com.

TAXES & ASSESSMENTS: Seller pays any unpaid real estate taxes at closing. Current year taxes and HOA dues (if any) are prorated to closing.

AGENCY: Higher Calling Auctions and its representatives are Exclusive Agents of the seller.

BROKER PARTICIPATION: Commission is paid to licensed brokers who properly register a successful buyer under the Broker Participation Agreement. This must be submitted 48 hours before the auction. No commission is paid if the licensed agent buys for themselves.
